1. Acceptance & Intermediary Status
These Terms of Use constitute a legally binding agreement between you (“User”, “Customer”, or “Salon Partner”) and [LEGAL COMPANY NAME] (hereinafter “BookMySaloonWala”, “We”, or “Us”).
BookMySaloonWala operates as an electronic technology intermediary under Section 2(1)(w) of the Information Technology Act, 2000. We provide digital discovery, booking management, and software tools. BookMySaloonWala does not own, operate, or provide physical salon, hair, skincare, or spa services. All physical beauty and grooming services are rendered by independent third-party Salon Partners.
💳 IMPORTANT PAYMENT CLAUSE: DIRECT CUSTOMER-TO-SALON SETTLEMENT
BookMySaloonWala does NOT collect, process, hold, receive, intermediate, or settle payments for salon services. Payments for all salon services are made directly by the Customer to the respective Salon Partner at the salon venue (or via salon-provided direct UPI QR codes, cash, or card swipe machines). Any dispute concerning service charges, payment receipts, or refunds must be resolved directly between the Customer and the Salon Partner.
2. Eligibility & Account Security
You must be at least 18 years of age and capable of entering into legally binding contracts under the Indian Contract Act, 1872. You agree to provide accurate, current information and maintain the security of your device and login credentials.
3. Prohibited User Activities
Users shall not:
- Make fraudulent or frivolous bookings with no intention of attending.
- Post defamatory, abusive, offensive, or false reviews regarding salons or staff.
- Attempt to scrape, reverse engineer, or compromise the security of the Platform.
- Misrepresent salon pricing, qualifications, or service capabilities.
4. Disclaimers & Limitation of Liability
To the maximum extent permitted by applicable Indian law:
- BookMySaloonWala disclaims all warranties regarding the quality, hygiene, aesthetic outcome, or safety of services performed by independent salons.
- BookMySaloonWala shall have zero liability for any bodily injury, allergic reaction, property damage, or counter disputes occurring at salon premises.
- The total aggregate liability of BookMySaloonWala for platform technology failures shall be strictly limited to the lower of fees paid by the user in the past 3 months or ₹1,000.
5. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any unresolved dispute shall be subject to the exclusive jurisdiction of the competent courts located at [CITY, STATE, INDIA].
